Patricia E. Lowry

Partner

Patricia E. Lowry focuses her practice on product liability and employment litigation, with expertise in pharmaceutical product liability defense. She has more than 20 years’ experience defending product cases including prescription medications, over-the-counter products and medical devices. Patricia has successfully defeated consumer fraud and marketing product claims including putative class actions.

Patricia is a Fellow of the American College of Trial Lawyers and has been listed among the Lawdragon 500 Leading Lawyers in America, a distinction honoring the most elite legal professionals in the country. 2010 marked Pat’s 20th anniversary of receiving an AV Preeminent rating from Martindale-Hubbell, the highest possible rating of ethical standards and legal work. In 2008 Patricia was recognized in south Florida as the Most Effective Lawyer in the Products Liability category by the Daily Business Review. In 2007 she was selected as the winner in the general legal category at the South Florida Business Journal and Citibank Key Partners Awards, an annual awards program honoring South Florida’s top CPAs and lawyers. In 2006, Patricia was appointed to the Supreme Court of Florida’s Judicial Ethics Advisory Committee by The Florida Bar Board of Governors. She has been selected for inclusion in Florida Super Lawyers, published by Thomson Reuters, a distinction recognizing the top lawyers in the state, each year since 2006, and has been listed as one of the Top 100 Lawyers in Florida. She is listed as a star in Benchmark: Litigation’s national ranking of product liability lawyers. Patricia is also listed in The Legal 500 US and Who’s Who Legal: Florida for her product liability practice, as well as in the 2010 Guide to the World’s Leading Product Liability Lawyers. She has been listed in The Best Lawyers in America and named a Leading Lawyer by Chambers USA: America’s Leading Business Lawyers each year since 2005; named a top US labor and employment lawyer in The International Who’s Who of Business Lawyers 2006; and recognized among Florida’s Legal Elite by Florida Trend each year since 2005. In addition, she has been recognized as a Top Lawyer in Florida by the South Florida Legal Guide each year since 2005.

In 2004 Patricia received the Women in Leadership Award, Private Sector, from Executive Women of the Palm Beaches. Patricia was also honored by the March of Dimes, Florida Chapter, as June 2006 Volunteer of the Month, a recipient of the 2009 Champions Award in Palm Beach County and one of its Palm Beach County Women of Distinction. She is a former president of the March of Dimes Palm Beach Board of Directors and is a board member of the March of Dimes Florida Chapter, as well as a member of the March of Dimes President’s Society.

Patricia served as a trial advocacy instructor at the International Association of Defense Counsel’s Trial Academy at Stanford Law School in 2006 and has served as a trial practice instructor for the Florida regional program of the National Institute for Trial Advocacy. A frequent speaker, in 2008 Patricia lectured at two national conferences sponsored by the American Conference Institute on the topics of preemption in drug and medical device consumer fraud cases and expert witness issues in drug and medical device cases. Patricia has lectured on punitive damages at Mealey’s Defense Strategies in Pharmaceutical Litigation conference in January 2006 and presented on “Hot Topics” at the May 2005 Drug and Medical Device Seminar of the Defense Research Institute. Patricia is co-author of “Defamation in the Workplace,” which was published in For the Defense.

Patricia is a past president of the Federal Bar Association – Palm Beach Chapter and a member of the invitation-only International Association of Defense Counsel, as well as the Defense Research Institute.

Prior to her career in private practice, Patricia was a judicial law clerk to The Honorable José A. Gonzalez Jr. of the United States District Court, Southern District of Florida.

    • Serving as Florida counsel and member of the national trial team in phenylpropanolamine (PPA) litigation defense, receiving a defense verdict from a Florida state jury.
    • Acting as Florida counsel and member of the national trial team in Baycol® litigation defense, managing hundreds of cases.
    • Serving as Florida trial counsel in the OxyContin® litigation defense, receiving a defense verdict in a federal trial on a Florida whistleblower claim brought by a former sales representative.
    • Serving as MDL defense liaison counsel in the Trasylol© litigation.
    • Serving on the national trial team and as South Florida regional counsel to a medical device company in orthopedic bone screw litigation.
    • Representing a pharmaceutical and health care company as its lead Florida counsel in the defense of more than 50 actions brought by HIV-positive and AIDS-infected hemophiliacs.
    • Advising a pharmaceutical and health care company in a significant market share case heard by the Supreme Court of Florida, which ultimately was settled before a final ruling.
    • Winning defense attorneys’ fees of more than US$50,000 from two judges in two federal discrimination cases, one of which was appealed and affirmed on appeal.
    • Winning directed verdict in a federal age discrimination claim arising from reduction in force.
    • Succeeding in appellate cases including a directed verdict in an age discrimination case.
    • Obtaining numerous summary judgments and dismissals of employment cases before trial that have been affirmed on appeal including a summary judgment based on sex discrimination, retaliation and Equal Pay Act claims.
    • Obtaining a reversal of a US$450,000 plaintiff’s age discrimination jury verdict in a case tried by other counsel.
    • Handling class action defenses.
