Albert A. del Castillo

Albert A. del Castillo serves as the firm’s Florida practice coordinator. He has an extensive public finance practice and has worked on bond issues throughout the country with particular emphasis in the state of Florida and the Commonwealth of Puerto Rico. He has been involved as bond counsel, underwriters’ counsel and disclosure counsel in a variety of issues including general obligation, infrastructure, electric, water and sewer, resource recovery, health care, sports facilities, educational facilities, special assessment, community development district and industrial development financing.

Over the years, Albert has served as bond counsel on many innovative and complex financings. For example, he served as bond counsel on a US$750 million auction rate financing by Citizens Property Insurance Corporation that was selected as The Bond Buyer’s 2004 Deal of the Year. He served as bond counsel to Broward County on a US$126.6 million passenger facility charge convertible lien airport bond financing for which Broward County was awarded the Government Finance Officers Association Award for Excellence in Government Finance. Albert has also served as letter of credit bank counsel and as trustee’s counsel.

In the aftermath of Hurricane Andrew, Albert played a primary role in authoring the legislative amendments that permitted a city to issue more than US$472 million in special insurance assessment revenue bonds. He later served as lead bond counsel in connection with the subsequent issuance of the long-term Hurricane Andrew Bonds. Albert also has served as special financing counsel to the Florida Residential Property and Casualty Joint Underwriting Association (JUA) in connection with a US$1.5 billion line of credit financing that provided liquidity funding to the JUA, a statutorily created property and casualty insurer of last resort in the state of Florida. He then represented the JUA in connection with a US$2 billion financing involving the restructuring of the original US$1.5 billion line of credit and issuance of US$500 million of taxable corporate notes. Albert served as special financing counsel (including assistance in drafting the necessary implementing legislation) in connection with the combination of the JUA and the Florida Windstorm Underwriting Association into Citizens Property Insurance Corporation, and he now serves as bond counsel to Citizens. In 2006, he served as bond counsel in connection with the issuance by Citizens of US$3.05 billion taxable High-Risk Account Senior Secured Bonds, Series 2006A, Florida’s largest single new-money municipal bond issue to date.

In addition to his Florida bond counsel experience, Albert has worked extensively on bond issues in the Commonwealth of Puerto Rico. His experience in Puerto Rico includes serving as bond counsel on the Commonwealth’s US$800 million Tax and Revenue Anticipation Notes, Series 2004A-1 and A-2 and US$555 million Public Improvement Bonds of 2003, Series A and Public Improvement Refunding Bonds, Series 2003; the Puerto Rico Electric Power Authority’s US$319 million Power Revenue Refunding Bonds, Series OO, PP and QQ, US$509.5 million Power Revenue Bonds, Series RR and US$483.9 million Power Revenue Refunding Bonds, Series SS; and the Puerto Rico Public Buildings Authority US$789 million Government Facilities Revenue and Revenue Refunding Bonds, Series C, D and E and US$466.1 million Government Facilities Revenue and Revenue Refunding Bonds, Series F, G and H.

Albert is a member of the National Association of Bond Lawyers. He serves on Georgetown University Law Center’s National Law Alumni Board and on the boards of the Memorial Hospital Foundation and the Joe DiMaggio Children’s Hospital Foundation. He served as an alternate member of the Charter Committee for the incorporation of the Town of Miami Lakes and was extensively involved in the drafting of the Town Charter. He is a past president and member of the boards of the Education Fund, a 501(c)(3) organization committed to providing private sector support to enhance the quality of public education in Miami-Dade County.

Albert is a Fellow of the American College of Bond Counsel. He is named in Florida Trend magazine’s 2011 list of Legal Elite for public finance and bonds, and has been listed in The Best Lawyers in America since 2006 and in Florida Super Lawyers, published by Thomson Reuters, since 2007. In 2006 Albert received the South Florida Business Journal/Citibank Key Partner award in the General Legal category, and he was named as one of South Florida's Most Effective Lawyers by Miami Daily Business Review. Albert is listed in Chambers USA as a recommended lawyer in the area of banking and finance and is AV-rated by Martindale-Hubbell.
