Sergey Treshchev focuses his practice on corporate, international trade, commercial banking, financial leasing and other financial transactions, mining, insolvency (restructuring) and litigation matters. He has extensive experience representing both lenders and borrowers in various transactions such as loans, securities transfers, mortgages and leases in Russia and abroad. He has also handled matters in securities, currency control and mining regulation. Sergey is listed in the 2012 edition of
Russia’s Best Lawyers for his corporate and energy and natural resources practice.
As a trial lawyer, Sergey has been involved in numerous commercial court cases ranging from complex banking disputes following Russia’s 1998 financial crisis, to import-export, customs and mining litigation and labor matters.
Sergey has negotiated, drafted and provided advice in connection with numerous banking agreements including loan agreements, correspondent account agreements, cash transfer agreements, sureties, guarantees and others, in Russia and former Soviet Union countries. Sergey has provided advice to banks and credit organizations on securities licensing, currency transactions licensing, export and import licensing, credit card transactions and contractual matters. He has conducted due diligence and document preparation for syndication loan transactions, lease transaction, pledge and mortgage transactions.
Sergey has advised and prepared documents in connection with internal and cross-border leasing transactions including leasing of railway carriages and flat cars, and telecommunications equipment. He has also provided advice concerning the issue and registration of mineral licenses, and participated in litigation and settlements related to mineral license holding. Sergey advised a nickel copper exploration company with assets in Eastern Russia in connection with its admission to the Alternative Investments Market.
Sergey has advised, prepared documents for and represented Russian and foreign clients in insolvency and restructuring proceedings involving, in particular, banks, pharmaceutical companies and gas servicing enterprises.
He has also advised international companies on the issue and registration of mineral licenses, participation in tenders and auctions, meetings with top-ranking officials of the Ministry of Natural Resources (and Rosnedra) and Ministry of Fuel and Energy of Russia regarding license holding, and negotiations and settlements related to the use of rights provided by a mineral license.
Previously, Sergey was the head of a legal department of a major Russia-based bank.
