Jessica E. DeMonte

Principal

Jessica DeMonte focuses her practice on environmental law and has experience in related advocacy matters including state and federal litigation, administrative practice before state agencies and corporate and municipal counseling.

Jessica’s experience includes defense of environmental citizen suits and third-party permit challenges and governmental civil and criminal enforcement actions involving alleged air, water and waste violations. She also has experience representing a variety of municipal and corporate clients in negotiating National Pollutant Discharge Elimination System (NPDES) and Title V permits. Jessica also has experience with the environmental permitting of public utilities in Ohio and conducts regulatory and legislative counseling in the energy context as well.

Currently, Jessica serves as manager of the Association of Ohio Metropolitan Wastewater Agencies (AOMWA). In this role, she is responsible for tracking legislative and regulatory developments on the state level and assists with developing AOMWA’s agenda. She also represents the group before legislators and regulatory agencies on a variety of matters including appeals of significant rules affecting membership organizations, such as recently adopted operator certification standards and credible data requirements in Ohio.

Jessica was listed in the 2011 and 2012 editions of Ohio Super Lawyers – Rising Stars, a listing of the top up-and-coming lawyers in the state.

Although a member of the Columbus office, Jessica resides in Chicago, Illinois.

    • Representing AOMWA during rulemaking proceedings for operator certification standards and creation of Ohio’s credible data program and representing AOMWA in the administrative appeals of these rules.
    • Assisting AOMWA in developing a state financial criteria study to supplement affordability analysis of members in long-term control plans to manage combined sewer overflows (CSOs).
    • Participating in the defense of a federal Clean Water Act citizen suit regarding alleged CSO/sanitary sewer overflow (SSO) violations that resulted in dismissal on jurisdictional grounds.
    • Counseling private commercial clients involved in the sale of contaminated property litigation.
    • Participating in bankruptcy proceedings and negotiation of regulatory proofs of claim relating to contaminated sites and Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) liability.
    • Assisting in the defense of an Ohio EPA enforcement action involving alleged violations of Ohio’s solid waste and water pollution control laws and regulations and negotiation of an extensive settlement.
    • Assisting in the defense of third-party administrative challenges to NPDES permits in Ohio and Michigan.
    • Participating in the defense of a Clean Water Act citizen suit regarding alleged failure to promulgate Total Maximum Daily Loads for Ohio water segments in accordance with a federal schedule.
    • Defending a Clean Water Act citizen suit alleging indirect discharge violations.
    • Providing counsel in numerous administrative appeals before the Ohio Environmental Review Appeals Commission involving challenges to NPDES permits and Title V permits issued by the Ohio EPA.
    • Defending successfully a mechanics lien claim in Illinois and defense of appeal.
