Douglas McWilliams’ practice encompasses all areas of environmental counseling with an emphasis on air permitting, enforcement and administrative procedure. Douglas has particular experience in complex major source permitting, the generation, use and trading of emission reduction credits and allowances, and rule development. He also counsels and represents clients in hazardous waste litigation and environmental enforcement cases.

Douglas’ air experience began with his work as a permit engineer for one of Southern California’s air pollution control districts where he processed air permit applications and implemented one of the first rules governing emission reduction credit banking and trading. He now advises clients in market-driven strategies for environmental compliance and innovative permitting solutions. In addition, Douglas assists municipal and industry stakeholders in gaining access to federal and state rule development processes under the Clean Air Act including new source review rules, maximum achievable control technology rules and ambient air quality designations.

Douglas has trial and appellate experience under the Clean Air Act and in the areas of hazardous waste litigation under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) and related state law claims. He also serves as common counsel to PRP organizations and advises clients on strategies for brownfield disposition and redevelopment. He has resolved civil and criminal enforcement matters on a full range of environmental issues before various administrative and judicial tribunals.

Douglas is a member of the Section of Environment, Energy, and Resources of the American Bar Association, the Ohio Bar Association and the Cleveland Metropolitan Bar Association. He is listed in recent editions of The Best Lawyers in America and Ohio Super Lawyers. He is also recommended by Chambers USA as a Leading Lawyer for Business in the area of Environmental Law.

    • Representing clients facing NSR and New Source Performance Standard enforcement actions.
    • Assisting in a challenge to the Clean Air Interstate Rule (CAIR) and participating in the development of successor state and federal rules.
    • Successfully demonstrating non-applicability of BART emission limits using complex regional modeling and participated in the development of state BART rules and SIPs.
