Scott A. Kane

Partner

Scott Kane is a member of Squire Sanders’ Litigation Practice Group and serves as managing partner of the Cincinnati office. He represents financial institutions, manufacturers, technology companies, design and construction firms, and other businesses in a variety of commercial litigation matters in courts and arbitration proceedings throughout the United States. He also has extensive experience representing both debtors and creditors in disputed matters in large Chapter 11 cases and other bankruptcy related litigation.

In addition to his active litigation practice, Scott is co-chair of the Squire Sanders eDiscovery & Data Management Team, which serves as a resource for lawyers and clients regarding defensible and cost effective strategies for the preservation and discovery of electronic documents. As an adjunct professor at the University of Cincinnati College of Law, Scott teaches a course on eDiscovery issues. He is a frequent speaker in this practice area to clients, bar association groups and professional organizations. Scott is also a member of the Electronic Document Retention and Production Working Group of The Sedona Conference.

Scott is a board member and former president of the Cincinnati/Northern Kentucky chapter of the Federal Bar Association. He also serves on the board of the Professionalism Committee of the Cincinnati Bar Association and is a member and past chairperson of the Common Pleas Court Committee. Scott is listed in the 2012 edition of The Best Lawyers in America and was selected as an Ohio Super Lawyer by Thomson Reuters in 2011 and 2012, a distinction honoring the top five percent of lawyers in the state. In 2008 he was given the Cincinnati Business Courier’s Forty Under 40 Award, recognizing the region’s rising business, community and economic leaders. Prior to law school, Scott served in the United States Army and is a veteran of Operation Desert Storm.

Representative Experience

    • Representing a special litigation committee of the board of directors of a casino gaming company concerning its independent investigation of potential claims arising from a US$8.9 billion leveraged buyout transaction.
    • Serving as lead trial counsel for a group of Chapter 11 debtors in a case involving more than US$2 billion of claims including successfully defending the debtors’ plan of reorganization against objections by state environmental agencies, the United States and private creditors at a multiday contested confirmation hearing.
    • Successfully defending a financial institution against class action claims by removing the case under the provisions of the Class Action Fairness Act and then obtaining dismissal of all claims in federal court prior to any ruling on class certification.
    • Successfully resolving multimillion-dollar cost overrun claims against a team of design and engineering firms concerning the construction of a National Football League stadium. 
    • Advising the Official Committee of Unsecured Creditors of Enron Corp. including litigation claims in the bankruptcy court and other jurisdictions, settlement issues, and the coordination of discovery for multifirm, multijurisdiction matters involving tens of millions of pages of discovery documents.
    • Representing a Fortune 500 manufacturing company in litigation with its former CEO concerning severance and ERISA issues.
    • Successfully representing a national banking association in complex litigation involving receivership, foreclosure on commercial real estate with ongoing business operations and lender liability claims.
