Labes’ practice focuses on serving as bond counsel, credit enhancement provider’s counsel, underwriter’s counsel, borrower’s counsel and issuer’s counsel on conduit financing transactions by public bodies for the benefit of private entities in the areas of multifamily housing, health care facilities (including hospitals) and other nonprofit facilities. He also has extensive experience working on transactions that utilize new markets tax credits (including leveraged structures), historic tax credits and low-income housing tax credits Mr. Labes is listed in The Best Lawyers in America for his public finance practice. Prior to joining the firm, Mr. Labes served as a judicial clerk to the US Court of Appeals for the Second Circuit.
Representative Experience
Serving as bond counsel and developer’s counsel in connection with the US$115 million redevelopment of a multifamily housing project near downtown Cleveland. Working on several transactions with local housing authorities and private developers that leveraged HOPE VI, Replacement Housing Factor, Section 202 and other federal funds with tax-exempt bonds and low-income housing tax credits. Serving as bond counsel on a US$93 million financing for the benefit of the Smithsonian Institution. Assisting the Cleveland Clinic Foundation, University Hospitals Health System and other health care systems in financing and refinancing more than US$2 billion. - Representing a community development enterprise (CDE) in connection with obtaining qualified equity investments and making qualified low-income community investments including leveraged structures involving state and federal historic tax credits in addition to new markets tax credits.
