Rebecca McAulay

Senior Associate

Rebecca practices predominantly in the areas of town planning, development, infrastructure, building, land compensation, environmental and administrative law.

Before being admitted to legal practice in South Australia in 2004 Rebecca gained experience working in the planning and environment department of a large metropolitan local government.  She later specialised in providing advice and representation to local government.

In 2011, Rebecca joined Squire Sanders as a where her primary focus has been advising developer, industry and mining clients and a number of local governments.

Rebecca regularly appears as counsel in mediations, reviews, appeals and enforcement matters.  She also provides strategic advice in regard to significant development proposals.

Rebecca is an executive committee member of the National Environmental Law Association (WA) and often presents to industry groups including the Planning Institute of Australia.  She recently became a co-author of Planning Law in Australia.

Representative Experience

    • Advising and representing a mining company before the State Administrative Tribunal in multiple mediations, and in the review of numerous development applications and licences for an extractive industry proposal.
    • Advising and performing due diligence on retirement village enterprises, industries, infrastructure and mines for interstate and international investors.
    • Advising and representing landowners with land compensation claims.
    • Advising on port, rail, mine and airport infrastructure.¡  Advising port authorities regarding an insurance claim recovery.
    • Advising on drafting town planning policies associated with major development projects and infrastructure.
    • Preparing deeds between developers, land owners and government regarding the future development of land.
    • Advising and representing numerous local governments in judicial review proceedings before the Supreme Court of South Australia.
    • Advising and representing numerous local governments and developers on town planning decisions before the State Administrative Tribunal, Environment, Resources and Development Court and the Supreme Court.
    • Advising on the relationship between the planning system and telecommunications legislation, particularly regarding “low impact facilities”.
