Solid Waste, Industrial Sewage & Pollution Control

Squire Sanders' lawyers have worked on hundreds of financings for solid waste disposal, industrial sewage and pollution control facilities, representing private business corporations, bond underwriters, financial institutions and government entities. These financings have been undertaken for the benefit of many different types of private end-users – electric utilities, oil companies, paper and wood products companies, steel companies, automobile manufacturers and mining companies, among others. 

Squire Sanders has extensive experience in a broad range in solid waste-related areas, including the tax exempt financing of both governmentally and privately owned projects; solid waste-fired energy plants; legal counseling with respect to, and drafting of, legislation to create solid waste management and other governmental authorities; the provision of legal advice to solid waste management authorities in connection with their planning and regulatory powers and responsibilities; the provision of environmental counsel in solid waste-related matters; and representation of governmental bodies in solid waste-related litigation, including the setting of tipping fees, siting issues and environmental litigation. Based on this broad experience, we have a detailed understanding of the solid waste industry and integrated solid waste management systems, and the broad range of issues that must be addressed by a governmental body to establish a successful program or facility. Moreover, we are sensitive to the legal issues involved in intergovernmental and public-private partnership relationships.

Over the years, we have represented clients in literally billions of dollars of pollution control, wastewater and sewage, and solid waste-related financings for both governmental and private sector borrowers. We have served as bond counsel, special tax counsel and underwriters’ counsel on tax exempt financings for a multitude of these projects, including water and sewer infrastructure, resource recovery facilities, landfills, materials recovery facilities and related projects.
