Peter Alfano has extensive experience counseling clients on antitrust and national security matters. In the area of national security representations, Peter is a leading practitioner in our International Trade Practice Group focusing on national security investment reviews. In this practice area, Peter is active in representing transacting parties, both US businesses and non-US investors, before the Committee on Foreign Investment in the United States (CFIUS), including negotiating assurance and national security mitigation agreements with CFIUS member agencies. As part of our International Trade Practice Group’s capabilities in representing global national security reviews, Peter often coordinates CFIUS reviews with similar reviews in other jurisdictions, such as reviews in Canada under the Investment Canada Act.
In addition to managing foreign investment reviews, Peter has almost a decade of antitrust experience including substantial merger review representation before US agencies, civil antitrust actions, criminal antitrust investigations and prosecutions, and general antitrust business counseling in areas such as distribution agreements, joint ventures and competitor collaborations. As a corollary to work on global antitrust and national security issues, Peter also counsels domestic and international clients in anticorruption compliance and government investigations involving the Foreign Corrupt Practices Act (FCPA) as part of the firm’s global FCPA team.
Given his trade and antitrust practices, Peter is able to offer clients unique solutions to business compliance goals, such as drafting, implementing, and auditing jurisdiction-specific and global antitrust and trade compliance programs.
Peter is a member of the New York, Massachusetts and District of Columbia Bar Associations and the Antitrust and Health Care Law Sections of the American Bar Association.
