Paul specialises in construction and engineering law and has experience in EU procurement law. Paul has knowledge of all the major standard forms of construction and engineering forms of contract and sub-contract, including the full range of JCT suite of contracts, ICE, MF/1, IChemE, FIDIC, NFDC and the LOGIC conditions of contract for marine construction.
Paul has considerable experience of procuring the delivery of high value complex projects for public and private sector clients using the full range of the NEC3 suite of contracts including the ECC, ECSC, TSC, PSC and SC forms. Paul has also had the benefit of in-house public sector experience having been seconded to the Olympic Delivery Authority’s in-house legal team to provide advice on the procurement and delivery of venues and infrastructure for the Olympic Games in London 2012.
Paul also has extensive knowledge on advising on the contract administration under standard form contracts, including advising on changes under the contracts and discrete commercial/strategic issues arising out of the project lifecycle.
Paul’s experience also includes the preparation and negotiation of bespoke contracts including construction aspects of PFI project agreements, building contracts, FM agreements, engineering and construction contracts, framework contracts for works and services, appointments for the professional team, collateral warranties, direct agreements, performance bonds, vesting agreements, off-site material bonds, guarantees, development agreements and purchase/sale agreements and asset protection agreements.
Representative Experience
- Advising a public sector client on the procurement of the construction of a re-instatement and extension of a station platform and associated rail track works split into two separate phases
- Advising a public sector client on the procurement of the design, construction, maintenance and de-commissioning of the temporary capacity enhancement works at a railway station including the negotiation of the relevant asset protection agreements with a private utility company and operator of the railway network
- Advising a public sector client on the procurement, contract strategy and the negotiation of asset protection and maintenance agreements for major sporting venues and associated infrastructure
- Acting for a contractor in respect of the installation and commissioning of a biomass plant in the Republic of Ireland
- Advising a transport client in connection with the upgrade and expansion of the metrolink network in the North West of England
- Acting for the private sector consortium on the Leeds Independent Living Social housing PFI project and advising on the construction aspects of the Project
- Seconded to a marine engineering consultant’s office to provide advice to the developer client on an offshore wind farm project for the procurement of 100 turbines generating 300 MW of renewable energy, including providing advice on the procurement of EPC contracts and the technical project documentation
- Acting for a major pharmaceutical company on the development of a site specific CHP facility
- Advising employers including a major airport on several civil engineering, demolition and environmental remediation projects
- Acting for a university institution, developers, employers, funders, tenants, purchasers, contractors and specialist subcontractors on a range of new build construction and refurbishment schemes including office accommodation, retail stores, healthcare schemes, residential and mixed use schemes
- Presentations to employer and contractor clients and conducting workshops on the various standard forms of contract including JCT, NEC2, NEC3, LOGIC and FIDIC forms of contract for EPC/Turnkey projects and offshore wind farm projects
