Ohad specialises in procurement and is responsible for the firm’s EU public, utilities and defence procurement practice. He is based in Brussels close to the European Institutions and NATO Headquarters and spends a significant part of his time in our four UK offices. Ohad advises private and public sector bodies on all aspects of the procurement process, from one-off issues to procuring, negotiating and drafting high value complex contracts. He advises clients across a variety of sectors including construction, nuclear, IT, infrastructure, housing, energy, transport, R&D&I, water, defence, public- private partnerships (PPP) and private finance initiatives (PFI). Dual qualified in the UK and in Israel, Ohad acts on general commercial matters for Israeli clients active in Europe and for international companies that do or want to expand their business to Israel.
Representative Experience
- Advising a leading US engineering and construction company in relation to bidding for several contracts across a number of countries for the operation of nuclear power plants.
- Assisting a UK Regional Development Agency in procuring a development partner for a major city centre mixed-use development project.
- Advising a local authority on the applicability of the “in-house” (Teckal conditions) exemption to a joint venture and to public-public partnerships.
- Successfully challenged a procurement award decision taken by a Housing Trust, resulting in the contract being awarded to our client, a UK based building company.
- Acting for a major mobile telephone service provider in relation to a number of tenders for the provision of mobile telephone services to public bodies in Bulgaria, including the submission and handling of a complaint to the European Commission on grounds of breach of the EU procurement Directives
- Advising on the procurement of a development partner for the development and regeneration of a town centre in the north of England.
- Advising a battery and charger manufacturer on a dispute before the European Commission and Greek national courts regarding the outcome of a major defence procurement contract in Greece.
- Advising a provider of rehabilitation services in relation to National Health Service contracts for the provision of Integrated Community Equipment Services.
- Assisting a major energy provider in the Utilities sector on the operation of framework agreements in compliance with the procurement regulations and on the “in-house” exemption.
- Advising a UK Regional Development Agency on the instigation of a competitive dialogue procurement scheme for the provision of a Regional Customer Relationship and Management Information System.
- Advising one of Spain's largest civil engineering companies on a tender procedure conducted by the European Commission (EuropaAid project) for the award of a contract for the construction of a sea water desalination plant in Cyprus.
- Advising a US operator in the defence sector in relation to a challenge against the UK Ministry of Defence procurement decision.
- Representing the European Commission before the European Courts in numerous cases involving an alleged breach of the procurement rules where the Commission had acted as an awarding entity.
