Nathan Lane is the former practice group leader for the Intellectual Property & Technology Practice Group. He has nearly 40 years of experience representing clients in disputes and business transactions involving intellectual property, antitrust, trade regulation and other complex issues.
Nate represents international businesses in litigation, arbitration and alternative dispute resolution proceedings in the United States and in international arbitration proceedings outside the United States. He has particular experience representing companies headquartered in Japan.
Nate is a member of the Antitrust, Intellectual Property, Litigation and International Sections of the American Bar Association. Nate is registered to practice before the United States Patent and Trademark Office and regularly represents clients in patent infringement litigation. He is the author of a chapter on discovery of evidence located abroad in a widely distributed California practice guide. Nate is a member of the Northern District of California Advisory Committee on Alternative Dispute Resolution Local Rules and is an active Mediator and Early Neutral Evaluator in the Northern District of California’s ADR program. He has been included in Thomson Reuters’ list of Northern California Super Lawyers since 2006.
Representative Experience
- Representing a heavy equipment manufacturing company in a seven-week patent infringement trial in the Eastern District of New York arising out of the sale of mobile aggregate processing equipment.
- Representing a Japan-based printing company in patent infringement litigation involving microlithography systems that was dismissed for lack of personal jurisdiction.
- Representing a Taiwan-based subsidiary of a Japanese company in litigation involving a breach of an indemnity agreement and a successful appeal to the Federal Circuit in the related patent infringement action.
- Representing a Japan-based manufacturer of RISC-based microprocessors in a patent infringement action through two jury trials and a successful appeal leading to final judgment in the client’s favor.
- Representing a Japan-based film manufacturer and its US subsidiary in defense of a patent infringement action in the Northern District of Illinois, resulting in a dismissal based on a successful jurisdictional defense and a subsequent settlement for less than the cost of defense.
- Representing an Internet startup company in a trademark infringement and antidilution action in the Western District of Pennsylvania, leading to a settlement, which included a substantial payment to the client.
