Nicholas Brannick focuses on general bankruptcy and restructuring issues, primarily representing corporate debtors and creditors’ committees.
Before entering the practice of law, Nicholas was an analyst for a transportation consulting firm, focusing on issues related to aviation economics.
He was selected for inclusion in the 2012 edition of Ohio Super Lawyers – Rising Stars, a listing of the top up and coming lawyers in Ohio.
Nicholas is the author of “At the Crossroads of Three Codes: How Employers Are Using ERISA, the Tax Code, and Bankruptcy to Evade Their Pension Obligations,” 65 Ohio St. L.J. 1577 (2004).
Representative Experience
- Representing the creditor’s committee in the bankruptcy of Mesaba Aviation, Inc., the eighth largest regional carrier in the United States; the confirmed plan resulted in 100-percent recovery plus interest to unsecured creditors.
- Representing Eos Airlines, Inc. as debtor in Chapter 11 proceedings.
- Representing Eurofresh, Inc. in its Chapter 11 reorganization proceedings.
- Representing the creditor’s committee in the cases of EnviroSolutions of New York, LLC and 21 related affiliates.
- Successfully litigating an 11 U.S.C. § 505(a) action, reducing real property tax liability by more than US$1.4 million.
- Arbitrating a dispute regarding the worker’s compensation policy of a Chapter 11 debtor, resulting in significant recovery by the debtor.
- Assisting in litigation regarding the perfection of security interest in assets of a Chapter 11 debtor, resulting in avoidance of liens.
