Mark C. Goodman

Mark C. Goodman focuses his practice on litigation for companies ranging from Fortune 100 corporations to small startups in the United States and internationally. He is particularly experienced in complex commercial cases including insurance coverage, product liability and mass tort actions, unfair competition actions, contract disputes and intellectual property. Mark has acted as lead counsel in multidistrict litigation involving consumer products. Mark’s extensive federal and state court appellate and trial experience includes landmark California advertising injury cases involving trademark, trade name and copyright disputes, as well as other intellectual property, antitrust, privacy and sophisticated business litigation matters. He has completed trademark registration and other transaction work around the world, handling the drafting of licensing agreements, e-contracts, leases and vendor agreements.

Mark has published several articles on insurance coverage and complex commercial litigation matters including articles on advertising injury coverage for intellectual property losses. Mark is listed in the Who’s Who in American Law. He has been regularly recognized as a Northern California Super Lawyer and as a member of the International Who’s Who of Professionals. Mark was included in the 2010 edition of The Legal 500 US.

Mark is a member of the American Bar Association and the Litigation and Intellectual Property Sections of the Bar Association of San Francisco.

Representative Experience

    • Acting as national coordinating counsel and court-appointed liaison counsel in nationwide complex product liability and mass tort claims.
    • Representing clients with respect to multidistrict litigation and class actions throughout the United States.
    • Litigating patent and trademark disputes in various jurisdictions in the United States.
    • Defending a claim involving a popular music group’s lawsuit against a computer company for alleged trademark, trade name and title infringement under English law.
    •  Defending a casual clothing and accessories manufacturer against alleged trademark infringement.
    • Obtaining reversals on appeal in both state and federal courts of punitive damages verdicts in complex commercial tort and insurance bad faith cases.
    • Obtaining a successful resolution of a trademark dilution and trespass claim arising out of the presence of unauthorized banner advertisements on websites.
    • Obtaining dismissal of US litigation between non-US-based corporations on the basis of inconvenient forum.
    • Providing counsel in the mediation and arbitration of numerous class action claims.
