Mark Ettershank focuses his practice on cross-border asset-based lending (including secured loan facilities, plant and machinery finance, factoring and invoice discounting, stock finance, floor plan financing and other forms of supply chain finance), banking and debt finance.
Mark also has experience in cross-border restructurings advising both lenders and borrowers on the acquisition, disposal and reorganization of stressed and distressed businesses.
Representative Experience
- Acting as lead counsel in the stabilization of a major financial institution’s leveraged and commercial finance portfolio including providing daily legal support to the operations team and account managers.
- Advising a pan-European telecommunications company in connection with a €200‑million syndicated financing.
- Advising a Czech Republic-based bank in relation to the €120‑million refinancing of a global trader and supplier of food stuffs.
- Acting for a lender in connection with a £27‑million asset-based loan facility in order to finance the acquisition of certain assets by a pan-European cable company.
- Advising a major Belgium-based bank in relation to the provision of an £8.5 million property and account receivables facility to a leading manufacturer and supplier of garage doors.
- Advising an asset-based lender in connection with the sale and restructuring of a major winery based in the UK and Australia.
