Mark D. Johnson

Senior Attorney

In 2000, Mark Johnson joined the firm’s regulatory practice group, where he focuses on telecommunications and intelligent transportation systems (ITS). Mark advises clients on a variety of regulatory and policy matters affecting the telecommunications and ITS industries as well as corporate governance, contract and transactional issues. He has regular interaction with the US Department of Transportation, Federal Communications Commission (FCC), US Congress, and state and local officials.

Before the FCC Mark has advised clients on obtaining radio spectrum for new wireless services, licensing and service rules for radio spectrum, obtaining a national three-digit code for accessing traffic and traveler information services, and other regulatory matters associated with emerging wireless technologies and services. He has also advised clients on the products liability implications of ITS products and services, standards development and equipment certification, corporate establishment and governance, and transactions involving the purchase and sale of wireless license assets. Mark has also had significant involvement in frequency rebanding issues, particularly associated with the 800 MHz band rebanding effort.

Mark has conducted liability risk assessment studies for new wireless products and transportation services, and certification programs for associated radio equipment. His work has included the development of business practice guidelines and contract protections to mitigate any potential liability exposure. He has advised clients on software licensing regarding warranties, limitations on liability, warnings and disclaimers. Mark has also provided clients with advice on strategic business and legal issues, such as structure, governance, financing and regulatory matters, concerning market introduction and market segment consolidation efforts for new wireless technologies and services in the United States and abroad.

Mark serves as outside counsel for the establishment and ongoing operations of a nonprofit industry trade association and equipment certification organization.

He is a frequent speaker at conferences for international, national and local groups interested in current telecommunications and ITS regulations and policies.

Prior to joining the firm, Mark was deputy general counsel of the leading international ITS industry association, the Intelligent Transportation Society of America (ITS America), where he served four years as legislative, regulatory and in-house corporate counsel. He also has practiced as a commercial litigator.

Mark is currently located in Squire Sanders’ independent network firm Estudio Bunge in Buenos Aires.
