Kunal Gadhvi

Senior Associate

Kunal Gadhvi’s practice covers a broad range of both contentious and non-contentious insolvency, focusing primarily on business sales and acquisitions, lender security reviews and enhancement, cross-border insolvency, antecedent transaction recoveries, wrongful trading and misfeasance actions and security enforcement. Kunal also has experience in general and commercial litigation and asset based lending litigation.

Prior to joining Squire Sanders, Kunal worked in the Business Recovery & Insolvency department of a niche insolvency practice in London, advising on predominantly contentious insolvency matters. His experience included working on VAT and Excise diversion fraud cases.

Representative Experience

    • Negotiating and advising officeholders, financiers and sellers in relation to the sale of businesses out of insolvency.
    • Acting for and advising banks and asset based lenders in relation to the default of their clients and the recovery, enforcement and insolvency procedures available to them.
    • Advising officeholders on cross-border insolvency issues, including advising a foreign officeholder on the recognition of foreign main proceedings under the Cross-Border Insolvency Regulations (“CBIR”) 2006 and the effects of recognition under Article 20 CBIR 2006.
    • Advising on insolvency proceedings against unregistered (foreign registered) companies.
    • Advising officeholders and asset based lenders on book debt recovery actions, including a substantial claim against the UK’s largest general-goods retailer.
    • Advising officeholders on preference, undervalue, misfeasance, wrongful and fraudulent trading actions and advising on the recovery of assets that defendant directors have attempted to put of the reach of creditors and the implications of s423 Insolvency Act 1986.
    • Acting for officeholders in various fraud actions, including injunctive relief (freezing and search orders) and tracing remedies, in particular actions against defendant directors and connected companies involved in Missing Trader Intra-Community (“MTIC”) fraud.
    • Advising the Financial Services Authority’s (“FSA”) Enforcement Division teams (whilst on secondment) on enforcement referral matters and actions against regulated firms and individuals in breach of FSA rules and principles.
    • Advising officeholders on personal insolvency matters including IVAs, bankruptcy, realisation of assets and disputes concerning the matrimonial home.
