Jochen P. Beck

Senior Associate

Jochen Beck is a senior associate in our EU, competition & trade practice based in our Brussels office. His particular expertise covers EU and national antitrust law and merger control as well as trade and WTO law, customs and export control, sanctions and embargoes. Jochen also assists clients in private antitrust proceedings before courts and in arbitration proceedings. In the area of trade law, he advises clients inter alia in antidumping and subsidy investigations, and on international trade matters.

Representative Experience

    Export control and customs
    • Implementing EU wide duty recovery programs for a multinational client.
    • Representing a photomask producer in an Binding Tariff Information appeal before the UK customs courts
    • Successfully representing a UK company in customs proceeding concerning the violation of export control procedures.
    • Implementing EU wide export control compliance programs for multinational clients.
    • Assisting a US/UK photo masks manufacturer in the preparation of compliance visits by the UK export control authorities (including conducting a mock compliance visit). In the course of this mandate the client further instructed us to prepared detailed export control compliance manuals for the UK and German subsidiaries.
    • Advising an international battery producer on export control compliance during technology transfers. The company is in the process of centralising email and SAP data from three EU Member States to a fourth one. The data to be centralised includes controlled military technology.
    • Advising on preferential rules of origin in the context of the provision of long-term supply agreements being requested by customers from a client.
    • Advising clients on implications of EU sanctions against Iran, Syria, Libya and other countries.
    • Conducting single and multi-day export control compliance trainings for various clients and speaking at international conferences.

    Antidumping, antisubsidy, regulatory and international trade
    • Successfully representing two EU producers (complainants) in an antidumping complaint and subsequent proceedings against certain chemicals originating in South East Asia.
    • Representing EU industries in the chemical, steel, and other sectors in antidumping complaints and subsequent investigations.
    • Representing an Indian stainless steel manufacture in parallel EU antidumping and antisubsidy proceedings.
    • Successful representation of a Belgian fertiliser producer in a complaint under Article 258 TFEU and in national German proceedings concerning mutual recognition in the area of free movement of goods (Articles 30 and 34 TFEU).
    • Assisting a WTO Member in the Airbus-Boeing dispute as a third party. Advising on the legal issues relating to the application of the Agreement on Subsidies and Countervailing Measures (ASCM) and the Dispute Settlement Understanding (DSU), in particular, in terms of the WTO consistency of government policies for development purposes.

    Competition law

    • Advising an airline company in an appeal of the EU the airfreight cartel.
    • Advising an Asian company in an appeal of a EU cartel decision by the Commission.
    • Advising a German association on Article 101 TFEU in relation to its vertical relations with up- and downstream industries with focus on possibilities to restrict sale of contractual products via the internet.
    • Advising an international transport company in a cartel investigation conducted by the European Commission, as well as a number of other non-European competition authorities, concerning alleged price fixing practices.
    • Preparing various merger filings to the German Bundeskartellamt and the Serbian Competition Commission on behalf of various clients including a major Ukrainian steel producer.
