Heather Stutz focuses her practice on litigation matters including federal and state court litigation and alternative dispute resolution. She has successfully litigated at both the trial and appellate court levels.
Heather has experience in matters involving complex business disputes including intellectual property rights and trade secrets, breach of contract, breach of fiduciary duty, tortious interference, unfair competition, accounting malpractice, creditors’ rights, healthcare regulation issues and antitrust litigation. Heather also has extensive experience with public sector matters including successfully defending the constitutionality of rules promulgated by a public library and successfully enforcing the rights of disabled children and the schools they attend. Heather’s clients include large corporations, healthcare systems, financial institutions, accounting firms and governmental entities.
Heather’s most recent experience includes litigation involving alleged anticompetitive conduct on the part of a large Ohio healthcare system, the protection of intellectual property rights including trademark and trade secret information, accounting malpractice claims and representation of large financial institutions.
In 2010 and 2012 Heather was selected for inclusion in Ohio Super Lawyers – Rising Stars, a listing of the top up and coming lawyers in the state.
Heather is a member of the American Bar Association, the Ohio State Bar Association and the Columbus Bar Association.
Representative Experience
- Obtaining a defense verdict for a large, vertically integrated healthcare system after a 10-week jury trial on state antitrust claims involving alleged treble damages of US$330 million.
- Obtaining a state medical license for a world renowned pediatric surgeon, who became the head of a new, state of the art pediatric surgery center.
- Obtaining a summary judgment, affirmed on appeal, against a constitutional challenge to rules promulgated by a public library.
- Successfully representing a large accounting firm against accounting malpractice claim involving alleged damages of tens of millions of US dollars.
- Successfully representing lenders in multiple workouts and creditors’ rights litigations.
