Gareth Timms’ practice focuses primarily on asset based lending litigation and he has over 11 years of experience working exclusively for asset based lenders on the contentious side. Gareth works on a range of claims from complex fraud actions often with an international aspect, obtaining injunctions and asset recovery to guarantor and indemnity actions and more complicated larger debt actions. His practice also includes making recoveries in foreign jurisdictions.

Gareth regularly lectures and provides clients with tailored presentations to highlight current trends and offer advice on how to tighten procedures to avoid losses.

Representative Experience

    • Dealing with a very complex £10.5 million fraud for a major bank involving the obtaining of freezing orders and leading to substantial recoveries.
    • Dealing with a multi jurisdictional £1.7 million fraud for a major independent discounter, obtaining additional security to support the sum due under the pressure of proceedings.
    • Collecting out a very large ledger for an invoice discounter, the ledger was very contractual and had issues relating to extended warranties, the strategy was changed from the one adopted, the discounter had provided for a substantial loss but we were able to recover all of their money in full including their contractual fees leading to a profit.
    • Dealing with the collections relating to a failed pay role service business, which involved recoveries from over 300 companies and warrantors.
    • Recovery of €280,000 from an Italian debtor after contested proceedings.
    • Recovery of £152,000 from a Dutch debtor who had been subject to an attachment by five UK based debtors, proceedings included removing the attachments obtained in England and thereafter the attachment in the Netherlands which resulted in the debt being paid.
    • Recovery of £465,000 from a Channel Island-based company involved in the online supply of goods into the UK.
    • Acting in numerous civil fraud actions against individuals resulting in substantial payments and recoveries.
