Gary L. Pasheilich

Associate

Gary Pasheilich is a member of our Environmental, Safety & Health Practice Group and brings diverse experience in complex civil and administrative matters involving federal and state air, water and hazardous waste laws. Gary counsels clients on environmental compliance, permitting and enforcement actions.

As a former associate assistant attorney general in the Environmental Enforcement Section of the Ohio Attorney General’s Office, Gary served as trial lawyer in numerous matters involving major source and air permitting, enforcement and administrative procedures. He also served as defense counsel for the director of the Ohio Environmental Protection Agency in more than 50 appeals before the Environmental Review Appeals Commission and involving a wide-range of permitting and rule-development issues. Gary also served as chair of the Advanced Energy Task Force, developing and facilitating cooperative efforts between the Office and various state government agencies, including the Ohio Air Quality Development Authority, Ohio Consumer’s Counsel, Ohio Department of Development, Ohio Department of Natural Resources and Ohio Department of Taxation.

Gary was a student law clerk for the Honorable Harland H. Hale of the Franklin County Municipal Court and extern for the Ohio State Supreme Court Judicial College.

Gary is a member of the Ohio State Bar Association. He served as vice chair of the Environment, Energy and Resources Section Litigation Committee and a member of the Environment, Energy and Resources and International Law Sections of the American Bar Association. He participated in the Save the Dream foreclosure prevention program.

Representative Experience

    • Counsel for the state of Ohio in complex civil and administrative litigation involving the largest single-site steel foundry in North America.
    • Serving as defense counsel in rule-making challenges brought by the electric generating utility industry involving the NOx SIP Call and Ohio’s NOx Budget Trading Program, the Clean Air Mercury Rule and the Clean Air Interstate Rule.
    • Serving as counsel for the state of Ohio in a landmark civil trial against a major asphalt manufacturer involving a diverse range of major and minor source permitting issues at more than 50 individual sources across Ohio. Successfully argued an appeal before the Tenth District Court of Appeals, prevailing on all assignments of error, and served as counsel for subsequent appeal before the Ohio Supreme Court.
    • Serving as counsel for the state of Ohio in litigation and settlement of the largest single-site, asbestos enforcement case in Ohio.
