Emily E. Root

Senior Associate

Emily Root focuses her practice on complex and general commercial litigation matters. She has represented clients in state and federal courts, as well as in international arbitrations. Emily is experienced in product liability matters, trade secrets law, unfair competition and other business torts, business contract actions, insurance litigation and alternative dispute resolution.

Emily is also a member of the Squire Sanders eDiscovery & Data Management Team, which serves as a resource for lawyers and clients in matters involving the presentation, discovery and use of electronic documents including e-mail; social media such as Facebook, Twitter, MySpace and LinkedIn; websites; and electronic data files.

Emily’s recent experience includes representing and counseling healthcare providers, billing companies and payors in relation to litigation on a wide variety of issues such as unfair competition, rate disputes, exclusive arrangement and joint ventures.

Emily also has experience representing entities involved in construction disputes including lenders, owners and contractors. She also has represented property owners and developers in proceedings to revise property values for tax purposes and in landlord-tenant litigation, including litigation arising out of claimed mold intrusion.

Representative Experience

    • Representing a manufacturer of high-density polyethylene drainage pipe in warranty, products liability and copyright disputes.
    • Obtaining a favorable resolution of a contract action on behalf of an insurance organization for recovery of amounts due under its policies.
    • Obtaining dismissal of claims made against a credit union by former officers and directors, including reversal of a multimillion-dollar judgment against it.
    • Defending successfully a client from the Republic of China in arbitration against claims related to intellectual property and trademarks after a share purchase transaction and for Chinese trademark licenses related to department stores in the People’s Republic of China.
    • Successfully defending a hospital’s decision to enter into an exclusive provider arrangement at the trial and appellate levels.
    • Advising a major manufacturer of residential water treatment equipment regarding litigation in France related to its distribution network.
    • Prevailing after argument before the United States Sixth Circuit Court of Appeals on behalf of a pro bono client.
    • Representing a pharmacy management and consulting subsidiary of a Fortune 100 company in trade secret, breach of fiduciary duty and noncompetition litigation with former officers.

    Distinctions
    • Selected by her peers and listed in the 2009 edition of Ohio Super Lawyers –Rising Stars, defined as the top 2.5 percent of lawyers age 40 and younger, or in practice 10 years or less.
