Emma Birch has a broad range of experience in general commercial litigation. Emma has spent a significant amount of time on secondment with a large bank which has allowed her to develop an excellent level of commercial acumen therefore tailoring her advice and practice to providing effective client- focussed solutions. Emma is experienced in acting for individuals and companies from SME's to PLC's and has experience in advising on a variety of matters of both a contractual and tortious nature including; misrepresentation, breach of contract/warranty, debt recovery, nuisance and professional negligence cases. Emma has particular expertise in banking litigation, as well as international enforcement actions.

Emma also has some experience in both construction and IP related disputes.

Representative Experience

    • Issuing and enforcing proceedings on a company in France.
    • Advising a leading Retail Bank in relation to a variety of consumer disputes including a large number of claims for misselling of payment protection insurance.
    • Advising a small business on the protection provided by a reciprocal service agreement with a company in India;
    • Advising an individual in relation to a fraudulent investment scheme.
    • Advising an employer as to enforcement of a costs order against an ex-employee.
    • Assisting the team in advising a Residents Association on the bringing of a group action in respect of a private nuisance claim against a local poultry processing plant.
