Donald A. Wall

Donald A. Wall has nearly 40 years of experience handling a broad range of commercial litigation and other methods of dispute resolution. His practice includes breach of contract, securities, fraud and misrepresentation, fiduciary duty, noncompete, trade secrets, intellectual property and a variety of business tort disputes. He has represented large and small businesses, governmental entities and individuals, including financial institutions, manufacturers, bankruptcy trustees and committees, inventors, insurers, and members of the hospitality industry. His work includes arbitration and other alternative dispute resolution proceedings, as well as actions in federal and state courts and regulatory investigations.

Donald also has considerable experience representing employers in employment-related matters including discrimination and retaliation claims, confidentiality and non-compete agreements, reductions in force, sexual harassment claims and issues arising from employment agreements and policies.  

Donald has spoken at a number of seminars on various litigation and employment law issues. He is a member of the American Bar Association’s Sections of Tort and Insurance Practice, Litigation, and Labor and Employment Law, as well as the Trial Practice and Employment and Labor Sections of the State Bar of Arizona. He is also a member of the Defense Research Institute and the Maricopa County Bar Association, as well as the Squire Sanders Ethics Committee.

Representative Experience

    • Representing a client in the prosecution of a patent infringement arbitration including confirmation of the award in federal court.
    • Conducting an internal investigation for a publicly traded company regarding accounting issues and financial disclosures. 
    • Counseling in the defense of an action seeking to invalidate a governmental financing structure as violative of the Arizona constitution.
    • Defending an insurance carrier in a trademark infringement lawsuit.
    • Representing a securities issuer in an SEC investigation.
    • Representing a trustee of a bankruptcy estate in prosecuting fraudulent transfer and fiduciary duty claims.
    • Representing a client in the prosecution of trade secret and restrictive covenant claims against a former employee.
    • Advising a resort hotel on the prosecution of a breach of contract action arising from cancellation of a scheduled convention.
    • Representing an insured in an insurance coverage dispute.
    • Defending a financial institution in a class action lawsuit alleging residential mortgage irregularities.
    • Defending a temporary restraining order and injunctive action against a financial transaction processing company.
    • Representing an owner in lease arbitrations with commercial and residential tenants.
    • Defending an employer in an age discrimination lawsuit.
    • Representing a bankruptcy creditors committee in connection with claims against financial institutions and others.
    • Representing the debtors of a hockey team in bankruptcy court disputes over team control.  
    • Representing the owner in a dispute with contractors regarding defects in the construction of a facility.
