Dominique Hartfield

Senior Associate

Dominique Hartfield’s experience includes both transactional and litigation work in employment and industrial law matters, and liquor licensing.

Dominique assists corporate and local government clients and provides strategic advice and representation on a wide range of human resources and industrial relations matters including occupational health and safety issues, workplace surveillance and privacy issues.

She has prior experience working for many years at a full-service independent Perth-based law firm.

Dominique is a committee member of The Law Society of Western Australia's Employee Relations Committee and a working member of the Association of Mining and Exploration Companies' (AMEC) internal safety reference group.

Dominique is also general member of The Law Society of Western Australia and the Industrial Relations Society of Western Australia. She is the editor/author of the Labour and Employment group's monthly legal update to clients, Workplace View.

Representative Experience

    Employment Law

    • Preparing a wide range of employment agreements, from executive to award based employee, for local, national and international clients.
    • Advising on the preparation of collective workplace agreements and the agreement making process.
    • Advising a range of corporate clients in relation to labor and employment aspects of due diligence reviews for local and interstate acquisitions, termination remuneration restrictions in the Corporations Act 2001 (Cth) and employment related commercial and executive employment agreements.
    • Defending a building company in relation to federal court proceedings brought by the Australian Building and Construction Commission in relation to breaches of the Fair Work Act 2009 (Cth).
    • Advising and representing clients in relation to adverse action and unfair dismissal claims and proceedings by employees.
    • Assisting in carrying out workplace investigations and advising clients in relation to bullying and harassment complaints, misconduct by employees and the management of underperforming employees.

    Workplace Privacy

    • Advising on workplace surveillance and privacy issues including the disclosure of medical records.

    Occupational Health and Safety Law

    • Representing the AMEC in the Legislative Review Working Group run by the Department of Mines and Petroleum (DMP) to review the Mines Safety and Inspection Levy Regulations 2010.
