Our experience includes conducting workplace audits to ensure compliance with employment law; maintaining union-free environments; and employment counseling arising from reporting obligations. We regularly work with clients in this industry to develop enforceable contracts addressing specific concerns including restrictive covenants and confidentiality of business and patient information as well as economic conflicts of interest. We work closely with our healthcare team on the Stark law and other implications of restrictive covenants and successfully enforce and defend noncompete agreements upon termination of employment.

We also work with our clients on workforce restructuring and staffing challenges unique to industry consolidation and acquisitions.

Our labor and employment lawyers work hand-in-hand with the Healthcare Practice Group on operational, medical staff, licensing and other professional issues when healthcare, employment and regulatory issues cross over. We have experience drafting medical staff bylaws as well as assisting providers with medical staff disputes. This includes the numerous transitional issues that arise when medical practices are purchased by hospitals.

  • Litigation — We are skilled in litigating disputes before the Equal Employment Opportunity Commission (EEOC), National Labor Relations Board (NLRB) and Department of Labor; individual and class action employment cases; contract, tort, wrongful discharge, discrimination and other employment-related litigation; and actions involving issues ranging from union management to drug testing.
  • Immigration — We advise healthcare clients on the sponsorship and employment of foreign nationals in the United States and throughout the world including assisting candidates with visa processing through the US Citizenship and Immigration Services (CIS).
  • Employee Benefits — Our team includes lawyers who focus on the design, drafting, implementation and administration of qualified and nonqualified employee benefit plans and arrangements.
