Carolina Soto Hernández focuses her practice on civil and commercial litigation. She represents multinational clients in various litigation procedures including collection claims, agency law matters, insurance claims, arbitrations, civil liability matters, foreclosures, employment and intellectual property disputes. Carolina has developed significant expertise in arbitration matters.
Prior to completing law school, Carolina was a law clerk in the district attorney’s office. She was also an assistant for Justice Luz Berenice Ubiñez de Barinas of the Superior Land Court, as well as for Justice Samuel Arias Arzeno of the Civil and Commercial Chamber of the Court of First Instance of the National District
As an adjunct professor at Universidad Iberoamericana (UNIBE) Law School, she teaches classes on alternative dispute resolution. She also teaches commercial arbitration as part of the Masters in business law at the Pontificia Universidad Católica Madre y Maestra (PUCMM) and recognition and enforcement of foreign decisions in the Dominican Republic as part of the Masters in business law and international litigation jointly offered by the PUCMM and Universidad Rey Juan Carlos in Madrid, Spain.
Representative Experience
- Obtaining an exequatur for recognition and enforcement in the Dominican Republic of two orders rendered by an arbitral panel, constituted according to the International Arbitration rules of the American Arbitration Association (AAA), placing a temporary receiver in two companies doing business in the Dominican Republic, a landmark Dominican case.
- Acting as Dominican team leader on behalf of the second largest telecommunications carrier in the Dominican Republic, and the only Dominican company ever listed in the New York Stock Exchange, in coordinating the discovery process resulting from motions filed in a Chapter 11 reorganization.
- Representing the Czech Republic in an international arbitration under the International Centre for Settlement of Investment Disputes (ICSID) Convention involving a claim in excess of US$50 million brought under the Bilateral Investment Treaty between Israel and the Czech Republic.
- Leading issues related to the litigation of various acquisitions of companies in various industries including electricity, consumer products and mining.
- Preparing arguments for potential arbitration under Chapter X of DR-CAFTA.
- Advising a major sports association in review of the arbitration clauses of contracts with players and staff.
- Representing foreign banks with collection claims and enforcement of guarantees in the Dominican Republic.
- Representing clients in various litigation matters related to possible arbitration under ICDR arbitration rules, including the validity of AAA arbitration under Dominican law and matters related to public policy.
- Providing legal representation of multinational clients in lawsuits based on Dominican agency law.
- Leading voluntary recall process of electronic equipment in the Dominican Republic, Caribbean and Latin America.
- Drafting arbitration clauses under national and international arbitration rules.
- Providing legal representation on behalf of an international financial institution against debtors and former shareholders, before regulatory authorities.
- Counseling a major bank in a criminal complaint against a former executive resulting from fraud against the bank and its clients.
- Representing a major electric company in tort and employment matters.
- Advising multinational companies on intellectual property criminal complaints regarding trademark, trade dress and copyright violations.
- Assisting clients with antibribery and money-laundering regulations including the preparation of company policies.
