Dale E. Papajcik

Dale Papajcik focuses his practice on counseling corporate senior management, staff and operations management clients in strategic and routine environmental, health and safety, commercial, real estate and insurance matters affecting US-based and international operations. Dale has extensive mine-related experience involving coal mining operations in Pennsylvania, West Virginia, Virginia and Alabama, and hard rock mining in Minnesota, Michigan and New York.

For 20 years Dale has represented a broad range of major manufacturing and mining clients on nearly every aspect of environmental health and safety law. His practice has principally focused on both civil and criminal enforcement defense of industrial clients and has involved all environmental media. Dale’s representations include some of the largest and most complex industrial and mining facilities in the United States. He has particularly broad experience in the Great Lakes states, Pennsylvania and Maryland. He has acted in both a legal adviser and business leadership role in the successful resolution of some of the most significant environmental enforcement cases in his region of practice. Securing environmental permits for mining, industrial and solid waste management entities under challenging conditions and timeframes has also been a major part of his practice.

Dale is a civil engineer. He spent eight years as a corporate environmental engineer and project manager for large coal and hard rock mining entities and Goodyear prior to practicing law.

Since the mid-1980s, Dale has represented industrial and commercial buyers and sellers in real estate transactions covering tens of thousands of acres of industrial, mining and commercial properties. These properties range in size from a corner gas station to large steel, chemical, automotive, and aerospace and defense facilities, to 10,000 plus-acre mining and agribusiness properties.

Dale has developed particular expertise in transactions involving brownfield redevelopment projects. He has directed the legal aspects of some of the largest US brownfield redevelopment project transactions including major projects in New York, Ohio, Pennsylvania, Indiana and Illinois. Industries he has represented include steel, coal and coke; chemicals; oil energy and petroleum refining; automotive; aerospace and defense; tire and rubber; coal, metal and mineral mining; metal manufacturing; waste management; and agribusiness.

Dale also has 20 years of active commercial practice experience representing buyers, sellers, debtors and creditors in transaction disputes involving all types of industrial products and services including raw materials and commodities, industrial products, intermediate processing, and engineering and construction projects.

Within his practice, he has broad experience in mergers and acquisitions, corporate governance, financial reporting, governmental and legislative affairs, and bankruptcy.

For a number of years Dale has acted as principal legal counsel on operational matters for an international steel producer. The representation involved the company’s creation, its growth to the largest steel company in the United States, its transformation into an US$8 billion public company and beyond.

He is a member of the Ohio State and American Bar Associations.
