Andrew R. Kruppa, who leads the Miami Litigation Practice Group, focuses his practice on trial and appellate matters. He has experience litigating a broad range of complex commercial disputes, product defect and liability claims, tort and bankruptcy matters. His litigation experience extends beyond Florida and Ohio, and includes representing clients at trial in California, Indiana, New York and South Carolina.
Andy was named a Rising Star in Ohio Super Lawyers in 2011 and 2012 after being selected by his peers as a top up-and-coming Ohio lawyer 40 years of age and younger or in the practice of law for less than 10 years. He is also listed as “up and coming” in Florida Trend magazine’s 2011 list of Legal Elite.

- Successfully obtaining reversal by the Indiana Supreme Court of a multimillion dollar wrongful death jury verdict by arguing that there was insufficient evidence of negligence by a major seatbelt manufacturer. Reported at TRW Vehicle Safety Systems, Inc. v. Moore, 936 N.E. 2d 201 (Ind. 2010).
- Successfully obtaining dismissal of a declaratory judgment action brought by an engineering firm that manufactured cruise ship propulsion systems against a group of insurers by arguing that the case – which involved an insurance policy that was executed in England, among largely English companies, and was governed by English law – should be resolved in English court. Reported at Rolls-Royce Commercial Marine, Inc. v. New Hampshire Insurance Co./AIG Europe (UK) Ltd., Case No. 09-61329, 2010 U.S. Dist. LEXIS 128925 (S.D. Fla. Dec. 7, 2010).
- Serving as lead trial counsel in a real estate development dispute and successfully defeating a motion for temporary injunction that would have resulted in the closing of an operating restaurant.
- Serving as trial counsel for a major seatbelt manufacturer against multiple claims including wrongful death and quadriplegia; the jury found the client not liable, although the client’s codefendant was held liable and ordered to pay a judgment of US$18 million.
- Serving as lead trial counsel for an automotive supplier in a contested proceeding in the Chrysler Bankruptcy valued in excess of US$17 million.
- Defending claims for US$30 million in damages against the seller of a nursing home conglomerate that were premised on alleged breaches of representation and warranties in a stock purchase agreement and obtaining a damages award in excess of US$1 million on the client’s counterclaim.
- Obtaining summary judgment for a seatbelt manufacturer in a case involving two wrongful death claims due to a rollover accident.
- Representing an automotive engine supplier in an FBI investigation for theft and fraud; no indictment was issued.
- Obtaining summary judgment for a major producer of specialty metals in a personal injury action based upon premises liability.
- Achieving a settlement, after obtaining indemnity from a co-defendant, for one of the world’s largest chemical manufacturing companies in a wrongful death action after the decedent asphyxiated inside of a chemical tanker that was used to haul his client’s materials.
