During the 1980s, our toxic and mass tort practice grew from our experience with asbestos defense to include suits claiming personal injury, increased cancer risk or property damage due to exposure to heavy metals and volatile organic compounds. The impact was seen across a wide variety of companies and industries. With increased litigation, Chapter 11 restructurings have become an important alternative to handling the impact of mass tort liabilities to keep the company going for all those concerned.
In addition to defending thousands of claims by individuals, we have substantial experience defending commercial environmental toxic tort claims, class actions and multidistrict litigation. Other environmental tort claims handled by our firm have included cases claiming injury and property damages arising out of alleged contamination from landfills and from plant operations, such as air emissions, surface and groundwater pollution and soil contamination.
