Alessandro Nucara

Alessandro Nucara is a senior associate in our Antitrust & Competition Practice Group based in our Brussels office. His particular expertise covers community law, European Commission (EC) and national competition law and state aid.
After having obtained his master’s degree in European Legal studies at the College of Europe (Bruges), Alessandro worked at an international law firm in Brussels from 2000 to 2003 covering all aspects of EC law and in particular EC competition law. Alessandro joined our former Rome office in January 2004, where he gained significant experience in Italy's antitrust laws, before moving to the Brussels office in March 2007.
Alessandro has developed an extensive experience in the state aid field. He also regularly advises clients on EC and national competition law, as well as general EC law, in a number of sectors including telecoms, media and energy.
Alessandro has also been visiting Professor of Law and Economics (Antitrust and State aid) at the University of Catanzaro (Italy) from 2007 to 2009 and is a regular lecturer at Italian universities on a variety of EU law subjects. He has also been a member of an internal judicial commission at the Italian Football Association from 2005 to 2008. He is fluent in Italian, English and Spanish.

Representative Experience
Antitrust
- Advising multijurisdictional filings of merger transactions at EU and national level and third party interventions in merger control proceedings in the iron ore and steel sectors.
- Advising in cartel proceedings before the European Commission in the foam sector.
- Advising the integration planning team of a major joint venture in the mobile telephony sector in the UK on antitrust compliance.
- Counseling a number of clients in different sectors (e.g. chemicals, pharmaceuticals, consumer goods) on antitrust compliance programmes and dawn raid trainings.
- Advising on a cartel investigation in the industrial gas sector before the Italian Antitrust Authority (including appeal proceedings before the competent administrative courts).
- Advising a major biotechnology company on a misleading advertising complaint before the Italian Antitrust Authority.
- Providing competition law advice to a major multinational in relation to vertical agreements in the pharmaceutical and consumer goods sectors, in particular in relation to exclusive and selective distribution agreements.
State Aid and EU Funding
- Representing a major broadcaster in Italy in a state aid case before the General Court.
- Providing state aid advice to a major automotive undertaking in relation to a publicly funded project in which universities and industry will carry out collaborative R&D projects.
- Representing the alleged beneficiaries in a restructuring aid case (textile sector) and in an R&D aid case (aviation sector) before the European Commission.
- Advising public authorities on public financing of the deployment of broadband infrastructures.
- Providing state aid advice to a UK RDAs on a number of projects related to: public financing of airport and port infrastructure; public funding of high-tech infrastructure where industry and universities will carry out collaborative research projects; energy-saving measures; collaborative research on low carbon technologies for the automotive sector; the set-up of three risk capital funds to provide financing to SMEs and land transactions.
- Advising both public and private sector clients on use of the EU structural funds and on EU-funded programmes (e.g. Eco-Innovation programme).
General EU law and Regulatory
- Advising a major TV operator in Italy on its participation in EU public consultations on creative content online, VAT directive and aid to public service broadcaster.
- Providing reference to the European Court of Justice for a preliminary ruling in a case related to the GMOs sector.
- Advising a major US telecommunications operator in relation to lobbying activities allowed under EU and national law.
