Alan L. Briggs

Alan L. Briggs’ practice focuses almost exclusively on trial law. After graduating from law school in 1967, Alan served in the US Navy’s Judge Advocate General’s Corps where he prosecuted and defended criminal cases. Since 1970 he has been engaged in general litigation practice.

Geographically, from 1970 to 1991, Alan practiced in Columbus, Ohio. In 1991 he transferred to the Squire Sanders Miami office and led the firm’s Florida litigation practice. In 1994 he transferred to Washington DC and served as head of Squire Sanders litigation on the East Coast until February 2007.

Substantively, his trial experience has been quite varied. In addition to his initial criminal trial work, Alan spent 15 years handling a wide mix of personal injury, white collar criminal and business litigation matters. Since 1985 Alan has concentrated his practice on business litigation, particularly in substantive areas that change with the economic times such as takeover, bankruptcy, real estate, insurance coverage, contract, financial institutions, product liability, unfair competition, intellectual property and class action litigation. Since joining the Washington DC office, he has obtained an LL.M. in patent and intellectual property law and has tried patent, trade secret and trademark lawsuits.

Alan has significant trial experience in state and federal courts and administrative agencies, representing both plaintiffs and defendants in 26 federal and state courts. He has been involved with more than 100 trials, almost equally divided between jury and bench trials. Alan is a Fellow of the American College of Trial Lawyers.

Representative Experience

    Intellectual Property
    • Winning a jury trial in state court in Ohio with a defense verdict for three scientists and their software company on claims of trade secret misappropriation relating to a chemoinformatics patent and software product and winning US$26.5 million on counterclaims for defamation, unfair competition and interference with business relations. The court also awarded our clients US$7.9 million for attorneys’ fees.
    • Winning a one-week jury trial in federal court in Pennsylvania defending a snow plow manufacturer accused of patent infringement.
    • Winning denial of an injunctive relief at a bench trial in federal court in Ohio for alleged patent infringement for a blood testing kit.
      White Collar Criminal Defense
    • Winning an acquittal for a defendant in a seven-week criminal jury trial in federal court in West Virginia on charges of conspiracy, mail fraud and wire fraud charges in connection with the sale of securities.
    • Winning an acquittal for defendant in a two-week criminal jury trial in Ohio on charges of fraud in connection with the sale of unregistered securities.
      Personal Injury
    • Winning a jury verdict in state court in Ohio and substantial damages for a plaintiff in a two-week medical malpractice action against an anesthesiologist.
    • Winning a jury verdict in state court in Ohio and substantial damages for a plaintiff in a two-week jury trial in a medical malpractice action again an orthopedic surgeon.
      Business and Commercial
    • Winning a jury verdict in state court in a one-week trial defending one of the largest fast food companies against a claim by a customer who maintained entitlement to a financial prize in a game.
    • Winning a directed verdict for an insurance company in a three-week jury trial in federal court in Florida for alleged interference with contract.
    • Winning a jury verdict in state court in Ohio in a two-week trial defending a real estate developer of a hotel restaurant complex in an action by the bank who loaned the developer funds with the winning defense based on lender liability defenses.
    • Winning a US$2.5 million dollar jury verdict in state court in Florida in a one-week jury trial on behalf of a commercial lender against a real estate developer defeating lender liability claims.
    • Winning a jury verdict in a two-week jury trial in Ohio representing commercial purchasers of computer hardware and software systems with jury upholding client’s revocation of acceptance of goods under the Uniform Commercial Code (UCC).
    • Winning a jury verdict in a two-week jury trial in Ohio representing commercial purchaser of a complex package sortations system with jury upholding revocation of acceptance under the UCC.
    • Winning a directed verdict in a two-week jury trial in state court in Maryland defending against claims of unfair competition.
    • Winning a jury verdict in a three-week trial for securities fraud in state court in Ohio representing NYSE Broker-Dealer.
    • Winning a jury verdict in a two-week state court trial in Ohio defending a national bank against claims of interference with contract.
    • Winning dismissal of multiple antitrust lawsuits in MDL in New Jersey on behalf of one of the nation’s largest insurance brokers.
    • Winning a two-week bench trial in state court in Virginia on behalf of a Virginia employer in a lawsuit brought by a former employee in a contract dispute for commissions.Winning an injunctive action in two days of trial in the District of Columbia in an action brought against a major bank by an employee applicant who claimed to have his job offer wrongfully revoked.
    • Winning a bench trial in a two-week trial in federal court in Ohio defending a franchisee of a nationwide employment firm against claims of franchise termination brought by the franchiser.
