Andrea Fisher’s practice includes bankruptcy litigation and bankruptcy matters. Andrea’s experience includes all aspects of bankruptcy litigation, with a particular concentration in litigation involving fraudulent transfers under the Bankruptcy Code and breaches of fiduciary duty on the part of corporate officers and directors. Andrea has assisted in trying cases in federal court and state court and has argued motions in both federal and state courts.

Andrea’s experience includes the representation as both general and special litigation counsel to a Chapter 7 trustee. On behalf of the client, Andrea conducted asset sales; prepared and prosecuted pleadings and motions including negotiating out-of-court settlements; appeared at adversarial hearings relating to assumptions and assignments of leases and contracts; and prosecuted preference and fraudulent conveyance actions. Andrea has also managed the claims objection and resolution process and is experienced in all aspects of trial preparation including depositions.

Andrea worked as a law clerk for The Honorable Jeffry H. Gallet of the United States Bankruptcy Court, Southern District of New York.

Representative Experience

• Representing the interests of creditors in the Chapter 11 bankruptcy process.
• Resolving a US$2 million claim with the New York State Department of Environmental Protection, which led to a full settlement of case.
• Assisting as special litigation counsel to the bankruptcy trustee of The Cassandra Group, whose principal was the so-called “investment adviser to the Hollywood stars," resulting in settlements of fraudulent transfer litigation totaling more than US$6 million.
• Assisting the lead restructuring counsel in all phases of numerous Chapter 11 cases.
• Researching novel and complex issues of law arising during Securities Investor Protection Act (SIPA) proceedings.
